GENERAL TERMS AND CONDITIONS –
BLUMMENATELIER ILONA SARL

These terms and conditions set the contractual relationship between the company Blummenatelier Ilona Sàrl and its customers. An order sent to www.ilona.lu implies acceptance of these terms and conditions.

1. Acceptance of these General Terms and Conditions
All orders made by customer on the website ilona.lu implies the acceptance of these terms and conditions. The website ilona.lu is operated by Blummenatelier Ilona Sàrl. No final order can be passed through by the customer if the customer has not previously accepted the terms and conditions by clicking on the check box provided. The client has at any time the possibility to modify or not to send his order.
These terms and conditions prevail over all other conditions contained in any other document, unless differently agreed by a written statement.

2. Products
All products are presented with their name, their brand (where applicable), their content (where applicable) and their quantity. Photos of the products are only indicative because the presentation of the products may sometimes change without a previous notice from the manufacturers or the suppliers. Colors and shapes of flowers, in particular, may appear different on photos and pictures of the website than they are in reality. The photos, pictures and illustrations of the products do not fall within the scope of the contract. The responsibility of Blummenatelier Ilona Sàrl will not be engaged for any such variations which are natural.
The products presented on the site are generally available. It may be, however, that a product could not be delivered. This missing product will then be deducted from the global order and will not be charged. In this case a brief note will appear on the delivery voucher. Blummenatelier Ilona Sàrl will do however its possible to ensure that the majority of products are always available.
It is important to know that adding a product in the cart does not mean an automatic order validation, because the product may become unavailable during the time from addition into the cart and the final submission of the order by the customer.

3. Price
Prices shown on the site ilona.lu include VAT, but do not include delivery costs and are only valid the day the website is visualised. The delivery costs will be shown at the moment of order validation.
When placing an order, the customer will be informed on the website by the applicable delivery costs, which are variable depending on the distance of the place of delivery from the shop Blummenatelier Ilona Sàrl, before final validation of the order by the customer.
Except display errors, we guarantee the prices shown on our website. Blummenatelier Ilona Sàrl cannot be held responsible for any display error.

4. Customer details – Data Protection
At the moment of an order, we ask the customer to fill out a form to define his address and name, the address for delivery (if different from the address of the customer) as well as credit card details. The filling of this form is mandatory since such data are essential for the correct handling of orders. This information will be saved on servers of Blummenatelier Ilona Sàrl and will be treated as confidential and will not be distributed to others. All customer data will be handled, used and processed by Blummenatelier Ilona Sàrl in compliance with the provisions of the Luxembourg law of August 2, 2002 on protection of persons with respect to processing of personal data.
The client has a right to access his personal data and to request rectification for all inaccurate data.
This article shall not prevent the sale or transfer of activities of Blummenatelier Ilona Sàrl to a third party.
The client has a tool to remove at any moment his account with Blummenatelier Ilona Sàrl.

5. Orders
All orders automatically generate an order confirmation sent by email to the customer’s email address specified when registering their contact data.
Blummenatelier Ilona Sàrl reserves the right to refuse an order in the case of a dispute with the customer.
Blummenatelier Ilona Sàrl reserves the right to contact the customer in the case of a large order to verify the accuracy of the order.
Blummenatelier Ilona Sàrl reserves the right to limit sold quantities in order to better manage its stocks.
Blummenatelier Ilona Sàrl offers the possibility of an automatic weekly order. The customer will accept a delivery on a weekly basis and this on a same day and in a same time frame. The customer agrees that the prices may fluctuate after activation of the automatic order.

6. Payments
Payments are made by credit card and Bank Transfer
We accept VISA, American Express and Mastercard credit cards.
Upon payment of the order, the credit card will not be charged. We only initiate a request for approval of the payment by the financial institutions responsible for your credit card. It is only after verification of the final order and after packing the day of delivery that we will charge the credit card.
The order will be accepted by the system after verification of the credit card. It is therefore up to the customer to check the type of the credit card and its validity.

7. Deliveries
Delivery is usually assumed by Blummenatelier Ilona Sàrl. When placing an order, the customer may choose the place he would like to be delivered.
However, for orders to deliver inside and outside the Grand-Duchy of Luxembourg, Blummenatelier Ilona Sàrl reserves the right to rely on any reputable local sub-contractor to supply and deliver the order of the customer in order to minimise delivery cost and delivery time, depending on distance and value of the order.
When ordering, the customer will indicate the precise place of delivery (home, office or other… including street names, street numbers, floors or other building references), the date and time slot. The goods will be supplied and/or delivered at that location as specified by the customer.
Blummenatelier Ilona Sàrl may not be held responsible for delays in delivery or non-delivery imputable to Blummenatelier Ilona Sàrl. If Blummenatelier Ilona Sàrl is responsible for a delay in delivery or a non-delivery, it will get in contact with the customer to give him the opportunity to defer or cancel all or part of his order. In the case of a cancellation due to non-delivery, Blummenatelier Ilona Sàrl then reimburses the full amount of the order.
If the customer is unable to receive its order at the specified time slot indicated to Blummenatelier Ilona Sàrl at order placement, he must notify Blummenatelier Ilona Sàrl as soon as possible, either by e-mail or by phone at least 24 hours before the selected time of delivery. Unless otherwise specified by Blummenatelier Ilona Sàrl, the additional cost of deliveries will then remain at the client’s charge.
In the case of an unexpected absence from the client, we will strive to lay down the ordered products either behind the house, if weather conditions allow, either with the neighbour. We will leave an information note on the customer’s door, but decline any responsibility for loss, theft or deterioration of merchandise in such case.
In the case of force majeure, such as war, accident, fire, power failure, failure of supply, epidemic, ice storm, earthquake, flood or any other reason beyond the control of Blummenatelier Ilona Sàrl, Blummenatelier Ilona Sàrl will be discharged of delivery, without the right for the customer to claim any compensation. Of course, Blummenatelier Ilona Sàrl will do everything to deliver the goods at a later moment.
Similarly, for any force majeure legally recognized, the client will be discharged of delivery reception and without the right for Blummenatelier Ilona Sàrl to claim any compensation.
In the case of an error in the address of the client during the initial capture of data at the registration, Blummenatelier Ilona Sàrl cannot not be held responsible for the inability to deliver the ordered goods.

8. Claims
For all flower products, plants and trees, only claims made the same day of the delivery will be considered.
Blummenatelier Ilona Sàrl is not liable for damages of any kind, bodily or material, which might arise from the wrong or inadequate use and consumption of its products.
Blummenatelier Ilona Sàrl is not liable for deterioration in the quality of its products after being delivered to the client.
Blummenatelier Ilona Sàrl saves, for an unlimited period, all electronic information relating to the transactions with its clients. This information will be used as evidence in the case of a legal dispute with the client.
Once past a delay of 24 hours after delivery, the customer will no longer be entitled to send any claims, with regard to compliance of the order or the status of the delivered products. All deliveries will be considered in accordance with the order.
In case of a dispute, Blummenatelier Ilona Sàrl will try to find an amicable solution together with its customer. If a dispute may not be solved, it will then be presented to the competent courts of justice in Luxembourg, which have exclusive jurisdiction. The governing law shall be the laws of Luxembourg.
